Welcome to Pixel Nova Byte. These Terms and Conditions govern your use of our website and services. By accessing our website or using our services, you agree to be bound by these Terms and Conditions.

1. Services Provided

Pixel Nova Byte provides professional website development services as outlined on our pricing page. We reserve the right to modify or discontinue any service at any time without notice.

2. Project Scope and Deliverables

All website development projects will be governed by a separate project agreement that specifies:

• Project scope, deliverables, and timeline
• Payment terms and schedule
• Revisions and change request policies
• Ownership and licensing of final deliverables

3. Payment Terms

Unless otherwise specified in a project agreement:

• A 50% deposit is required to begin work on all projects
• The remaining 50% balance is due upon project completion before final delivery
• All payments are non-refundable except as outlined in our Refund Policy
• Additional work beyond the original scope will be billed at our standard hourly rate

4. Intellectual Property Rights

4.1 Client Materials

You retain all rights to materials you provide to us (logos, text, images, etc.) and grant us a license to use these materials solely for the purpose of completing your project.

4.2 Final Deliverables

Upon full payment, you will receive ownership of the final website design and code developed specifically for your project. We retain the right to display your project in our portfolio and marketing materials.

4.3 Third-Party Materials

Any third-party materials (fonts, stock images, plugins, etc.) used in your project may be subject to separate licensing terms and additional fees.

5. Client Responsibilities

As our client, you agree to:

• Provide all necessary materials and information in a timely manner
• Review deliverables and provide feedback within agreed timelines
• Make timely payments as outlined in the project agreement
• Obtain necessary permissions for any materials you provide

6. Limitation of Liability

Pixel Nova Byte shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of our services or website. Our total liability for any claim shall not exceed the amount paid by you for the services in question.

7. Termination

Either party may terminate a project agreement with written notice if the other party breaches these Terms and fails to cure such breach within 30 days of notice. In the event of termination by the client, all payments made are non-refundable, and client will be billed for work completed to date.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.

9. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Continued use of our services after changes constitutes acceptance of the new Terms.
